§264-44  Maintenance of state highwaysystem.  (a)  The maintenance of the state highway system may be performedeither by public employment or by contract, or the director of transportationmay have the maintenance performed by the county in which the highways aresituated, by public employment or by contract, upon authorization of thelegislative body of the county concerned.

(b)  All maintenance work shall consider theextent to which work undertaken will increase traffic congestion and thedirector shall ensure that action is taken to reasonably minimize any adverseimpact.  The feasibility of off-hour maintenance work shall be considered forall maintenance work that results in significant traffic congestion or delay.

(c)  As used in this section, "off-hourmaintenance work" means maintenance work performed between the hours ofsix o'clock p.m. and six o'clock a.m. [L 1967, c 163, §3; HRS §264-44; am L1992, c 42, §3]
