§264-75 Compensation for removal of
outdoor advertising. (a) The director of transportation may acquire by
purchase, gift, or condemnation, and pay just compensation upon the removal of
any outdoor advertising lawfully erected.
(1) Those lawfully in existence on October 22,
1965.
(2) Those lawfully on any federal-aid or state
highway on or after October 22, 1965, and before January 1, 1968.
(3) Those lawfully erected on or after
January 1, 1968.
(b) The compensation will be paid only for the
following:
(1) The taking from the owner of the outdoor
advertising of all right, title, leasehold, and interest therein; and
(2) The taking from the owner of the real property on
which the outdoor advertising is located, of the right to erect and maintain
