§312-22 Library fee for enhancedservices special fund. (a) There is established in the state treasury thelibrary fee for enhanced services special fund into which shall be depositedall moneys collected pursuant to section 312-21 and any fee schedules adoptedpursuant thereto.
(b) The special fund shall be administered bythe state librarian who, after consultation with the library advisorycommittee, shall determine the annual amount that each public library shallreceive. Allocations shall be based on the balance in the special fund on thefirst day of each fiscal year and made in quarterly installments not more thanthirty days after the close of each fiscal quarter.
(c) Moneys allocated from the special fundshall be used by each public library to operate its fee for enhanced servicesprogram. Each library shall post in a conspicuous place a list of expendituresmade by the library from the special fund during the preceding fiscal quarter.
(d) The state librarian shall submit an annualreport on the status of the special fund. The report shall include informationabout:
(1) Deposits made into the fund and the source ofthese deposits;
(2) Allocations to each public library, includingallocations established for both the fiscal year covered by the annual reportand the subsequent fiscal year;
(3) Descriptions and amounts of the expenditures madefrom the fund;
(4) The balance remaining in the fund on June 30 ofeach year;
(5) Financial information regarding receipt sourcesby individual libraries; and
(6) Actual expenditure of receipts by individuallibraries.
The report shall be submitted to the legislature andthe governor not later than twenty days prior to the convening of each regularsession. [L 1993, c 327, pt of §1; am L 1999, c 45, §2]
