§327G-9  Decisions by guardian.  (a)  Aduly appointed guardian for the principal shall comply with the principal'spreferences or instructions expressed in the advance mental health caredirective and shall not revoke the principal's advance mental health caredirective, unless otherwise expressly authorized by a court of competentjurisdiction.

(b)  Absent a court order to the contrary, amental health care decision of an agent takes precedence over that of aguardian.

(c)  A mental health care decision made by aguardian for the principal is effective without judicial approval, unlesscontrary to the principal's preferences or instructions expressed in theadvance mental health care directive. [L 2004, c 224, pt of §2; am L 2005, c22, §16]
