[§328C-6]  Donated drugs repository.  [Sectionrepealed on July 1, 2010.  L 2004, c 190, §11.]  (a)  Prescription drugsthat meet the requirements of section 461-11.5, but are otherwise notappropriate for return-for-credit-and-reuse as defined in section 328B-2, maybe donated to repository entities.  Prescription drugs from individual membersof the public shall not be accepted for donation.

(b)  Donations to repository entities shall bemade without credit to the original payer for the cost of the drugs.

(c)  Prescription drugs donated to a repositoryshall have the patient's name removed or redacted from the product, includingthe label.

(d)  Drugs donated under this section that arenot used or accepted by a repository in the State of Hawaii may be distributedto repositories for use outside of the State. [L 2004, c 190, pt of §3]
