§328J 8 - Declaration of establishment as nonsmoking.

[§328J‑8]  Declaration ofestablishment as nonsmoking.  (a)  Notwithstanding any other provision ofthis chapter, an owner, operator, manager, or other person in control of anestablishment, facility, or outdoor area may declare that an entire establishment,facility, or outdoor area or any part thereof as a place where smoking isprohibited.

(b)  Smoking shall be prohibited in any placein which a sign conforming to the requirements of section 328J-9 is posted. [L2006, c 295, pt of §2]
