§334-13  Representative payee program.  (a) There is established a representative payee program within the department ofhealth, to be administered by the director of health, to provide representativepayee services to “mentally ill persons”, “persons suffering from substanceabuse”, and persons referred from the department of human services who receivefinancial assistance and have a primary medical diagnosis of substance abuse.

(b)  In developing this program, the departmentof health shall consider the following:

(1)  Services to the neighbor islands;

(2)  Training for representative payees;

(3)  Representative payees for care home residents;

(4)  Representative payees for homeless persons;

(5)  The use of case managers as representativepayees;

(6)  The development of due process procedures toprotect the rights of mentally ill persons and persons suffering from substanceabuse; and

(7)  The development and implementation of aninter-agency working agreement with the department of human services to carryout the purposes of this program. [L 1990, c 169, §2; am L 1995, c 207, §3]
