§338-7  Registration of foundlings;foundling report.  (a)  Whoever assumes the custody of a living child ofunknown parentage shall immediately report, on a form to be approved by thedepartment of health, to the local agent of the department the following:

(1)  Date and place of finding or assumption ofcustody;

(2)  Sex;

(3)  Color or race;

(4)  Approximate age of child;

(5)  Name and address of the person or institutionwith whom the child has been placed for care;

(6)  Name given to the child by the finder orcustodian.

(b)  The place where the child was found orcustody assumed shall be known as the place of birth, and the date of birthshall be determined by approximation.

(c)  The foundling report shall constitute thecertificate of birth.

(d)  If a foundling child is identified and aregular certificate of birth is found or obtained, the report shall be sealedand filed and may be opened only upon order of a court of competentjurisdiction. [L 1949, c 327, §11; RL 1955, §57-10; am L Sp 1959 2d, c 1, §19;HRS §338-7]
