[§340E-4.5]  Tampering with public watersystems, penalties.  (a)  Any person who tampers with a public watersystem, attempts to tamper with a public water system, or threatens to tamperwith a public water system shall be imprisoned for not more than five years andfined an amount not exceeding $500,000.  If the person is an individual, thefine shall not exceed $250,000.

(b)  Any person who tampers, attempts totamper, or threatens to tamper with a public water system shall be civillypenalized not more than $50,000.

(c)  For the purposes of this section, the term“tamper” shall mean:

(1)  To introduce a contaminant into a public watersystem with the intention of harming persons; or

(2)  To otherwise interfere with the operation of apublic water system with the intention of harming persons. [L 1987, c 165, ptof §1]
