[§342B-25]  Approval of permit.  (a) The director shall issue a permit for any term not exceeding five years if itis determined that the source will comply with all requirements of this chapterand the rules and standards adopted pursuant to this chapter.

(b)  The permit may be subject to suchreasonable conditions as the director may prescribe, including emissionlimitations or other conditions to assure compliance with all hazardous airpollutant maximum achievable control technology standards or rules adoptedpursuant to this chapter.

(c)  The director, on application, shall renewa permit for a term not exceeding five years, if it is determined that thesource complies with all requirements of this chapter and the rules andstandards adopted pursuant to this chapter.

(d)  The director shall not deny an applicationfor the issuance or renewal of a permit without affording the applicant anopportunity for a hearing in accordance with chapter 91.

(e)  The director shall not issue a permit fora covered source if the administrator timely objects to its issuance. [L 1992,c 240, pt of §1]
