[§342D-33]  Knowing violations.  Anyperson who:

(1)  Knowingly violates this chapter or any ruleadopted by the department pursuant to this chapter, or any condition in apermit issued under this chapter or any requirement imposed in a pretreatmentprogram; or

(2)  Knowingly introduces into a sewerage system orinto a publicly owned treatment works any water pollutant or hazardoussubstance which such person knew or reasonably should have known could causepersonal injury or property damage or, other than in compliance with allapplicable federal, state, or local requirements or permits, which causes suchtreatment works to violate any effluent limitation or condition in a permitissued to the treatment works under this chapter;

shall be punished by a fine of not less than $5,000nor more than $50,000 per day of violation, or by imprisonment for not morethan three years, or by both.  If a conviction of a person is for a violationcommitted after a first conviction of such person under this section, punishmentshall be by a fine of not more than $100,000 per day of violation, or byimprisonment of not more than six years, or by both.
