[§342G-103]  Deposit beverage distributors;registration, recordkeeping requirements.  (a)  By September 1, 2002, alldeposit beverage distributors operating within the State shall register withthe department, using forms prescribed by the department, and shall notify thedepartment of any change in address or other information previously submitted. After September 1, 2002, any person who desires to conduct business in theState as a deposit beverage distributor shall register with the department nolater than one month prior to the commencement of the business.

(b)  All deposit beverage distributors shallmaintain records reflecting the manufacture of their beverages in depositbeverage containers as well as the importation and exportation of deposit beveragecontainers.  The records shall be made available, upon request, for inspectionby the department; provided that any proprietary information obtained by thedepartment shall be kept confidential and shall not be disclosed to any otherperson, except:

(1)  As may be reasonably required in anadministrative or judicial proceeding to enforce any provision of this chapteror any rule adopted pursuant to this chapter; or

(2)  Under an order issued by a court oradministrative agency hearings officer. [L 2002, c 176, pt of §2]
