ยง342G‑114ย  Redemption centers.ย  (a)ย Prior to operation, redemption centers shall be certified by the department.

(b)ย  Applications for certification as aredemption center shall be filed with the department on forms prescribed by thedepartment.

(c)ย  The department, at any time, may reviewthe certification of a redemption center.ย  After written notice to the personresponsible for the establishment and operation of the redemption center and tothe dealers served by the redemption center, the department, after it hasafforded the redemption center operator a hearing in accordance with chapter91, may withdraw the certification of the center if it finds that there has notbeen compliance with applicable laws, rules, permit conditions, orcertification requirements.

(d)ย  Redemption centers shall:

(1)ย  Accept all types of empty deposit beveragecontainers for which a deposit has been paid;

(2)ย  Verify that all containers to be redeemed bear avalid Hawaii refund value;

(3)ย  Pay to the redeemer the full refund value ineither cash or a redeemable voucher for all deposit beverage containers, exceptas provided in section 342G-116;

(4)ย  Ensure each deposit beverage container collectedis recycled through a contractual agreement with an out-of-state recycler or anin-state recycling facility permitted by the department; provided that thisparagraph shall not apply if the redemption center is operated by a recyclerpermitted by the department;

(5)ย  Remain open at least thirty hours per week inhigh density population areas, of which at least five hours shall be onSaturday or Sunday; and

(6)ย  Forward the documentation necessary to supportclaims for payment as stated in section 342G-119.

(e)ย  Redemption centers' redemption areas shallbe maintained in full compliance with applicable laws and with the orders andrules of the department, including permitting requirements, if deemednecessary, under chapter 342H.

(f)ย  The department shall develop procedures tofacilitate the exchange of information between deposit beverage containermanufacturers, distributors, and retailers and certified redemption centers,including but not limited to universal product code information for reversevending machine purposes.ย  The procedures developed by the department shallallow for a reasonable time period between the introduction of a new depositbeverage product and the deadline for submitting universal product codeinformation to certified redemption centers operating reverse vending machines.[L 2002, c 176, pt of ยง2; am L 2004, c 241, ยง8; am L 2005, c 227, ยง2; am L2007, c 285, ยง7]
