§342J-4  Powers; rulemaking; appointment ofhearings officers.  (a)  The director may make, amend, and repeal staterules which govern the management of hazardous waste and which control andprohibit hazardous waste pollution.  All rules shall be adopted pursuant tochapter 91.  Any person heard at the public hearing shall be given writtennotice of the action taken by the department with respect to the rules.

(b)  In addition to other specific powersprovided in this chapter, the director may appoint without regard to chapter76, hearings officers to conduct public participation activities includingpublic hearings and public informational meetings.
