§346D-2  Establishment of medicaid home andcommunity-based waiver programs.  (a)  Waiver programs shall be establishedand administered by the department of human services to provide comprehensivehome and community-based services for aged, chronically ill, disabled,developmentally disabled, and mentally retarded individuals, who are certifiedas requiring acute, skilled nursing, intermediate care facility, orintermediate care facility for the mentally retarded level of care.

(b)  These services shall be furnished toindividuals in the geographic areas of the State identified in the approvedwaiver program applications.

(c)  Medicaid home and community-based waiverprogram expenditures shall not exceed the amount authorized by the federalHealth Care Financing Administration.
