ยง346D-3ย  Determination of eligibility forparticipation in a waiver program.ย  (a)ย  To qualify for participation in awaiver program, individuals shall:

(1)ย  Be determined by the department of human servicesto be eligible for federally-funded medicaid assistance;

(2)ย  Be certified by the department of human services,through the preadmission screening process, to be in need of acute, skillednursing facility, intermediate care facility, or intermediate care facility forthe mentally retarded level of care; and

(3)ย  Choose to remain in the community with theprovision of home and community-based waiver program services as an alternativeto institutionalization.

(b)ย  Individuals approved for a waiver programshall have the following:

(1)ย  Comprehensive assessment of their health,functional, social, and environmental needs;

(2)ย  Written service plan that addresses the necessarysafeguards to protect the health and welfare of the individual, and reflectsthe individual's freedom of choice of providers and services;

(3)ย  Budget based on the services defined in theservice plan; and
