[§346-345]  Special fund.  (a)  There isestablished within the state treasury to be administered by the department, thestate pharmacy assistance program special fund, into which shall be deposited:

(1)  Allmoneys received from manufacturers that pay rebates as provided in section346-342(g);

(2)  Appropriationsmade by the legislature to the fund; and

(3)  Any other revenues designated for thefund.

(b)  Moneys in the state pharmacy assistanceprogram special fund may be used for:

(1)  Reimbursementpayments to participating pharmacies for co-payments required under the federalmedicare part D pharmacy benefit program as provided to state pharmacyassistance program participants;

(2)  Thecosts of administering the state pharmacy assistance program, including salaryand benefits of employees, computer costs, and contracted services as providedin section 346-342(d); and

(3)  Anyother purpose deemed necessary by the department for the purpose of operatingand administering the state pharmacy [assistance] program.

All interest on special fund balances shallaccrue to the special fund.  Upon dissolution of the state pharmacy assistanceprogram special fund, any unencumbered moneys in the fund shall lapse to thegeneral fund.

(c)  The department shall expend allrevenues received from rebates paid by pharmaceutical manufacturers pursuant tosection 346‑342(g) to pay for the benefits to enrollees in the statepharmacy assistance program, the costs of administering the program, andreimbursement of medicaid pharmaceutical costs.
