ยง346-59.4ย Medical assistance to otherchildren.ย [Repeal and reenactment on June 30, 2010.ย L Sp 2009, c 8, ยง2.]ย The department shall provide state-funded medical assistance free of charge topersons less than nineteen years of age whose family income is at or belowthree hundred per cent of the federal poverty level for Hawaii and who are:
(1)ย Legal permanent residents who arrived afterAugust 22, 1996;
(2)ย Persons who are permanently residing under colorof law; and
(3)ย Nonimmigrants from the Trust Territories of the Pacific Islands who are citizens of:
(A)ย The Marshall Islands;
(B)ย The Federated States of Micronesia; or
(C)ย Palau, as defined by the Compact of FreeAssociation Act of 1985, P.L. 99-239, or the Compact of Free Associationbetween the United States and the Government of Palau, P.L. 99-658,
who are otherwise eligible for benefits under theState's medicaid programs, including QUEST and the State's children healthinsurance program, but are ineligible due to restricted eligibility rulesimposed by Title XXI of the Social Security Act, the Personal Responsibilityand Work Reconciliation Act of 1996, the Compact of Free Association Act of1985, P.L. 99-239, the Compact of Free Association between the United Statesand the Government of Palau, P.L. 99-658, or any other provision of federal lawdenying medical assistance to nonimmigrants who are citizens of the MarshallIslands, the Federated States of Micronesia, or Palau.
