§350-1.4  Confidentiality.  (a)  Allreports to the department concerning child abuse or neglect made pursuant tothis chapter, as well as all records of such reports, are confidential.  Thedirector may adopt rules, pursuant to chapter 91, to provide for theconfidentiality of reports and records and for the authorized disclosure ofreports and records.  Any person who intentionally makes an unauthorizeddisclosure of a report or record of a report made to the department shall beguilty of a misdemeanor.

(b)  Every reasonable good faith effort shallbe made by the department to maintain the confidentiality of the name of areporter who requests that the reporter's name be confidential.

(c)  Notwithstanding subsection (a) and section346-10, the director may adopt rules pursuant to chapter 91 to provide for therelease of information required by federal statute or regulation. [L 1987, c204, §2; am L 1999, c 34, §2]
