[§356D-127]  Determination of eligibilityand need.  (a)  The provider agency operating and managing a homelessfacility, or any other program for the homeless authorized by this part, or theauthority operating and managing its own homeless facility, shall beresponsible for determining if an applicant is eligible for shelter or otherservices at the homeless facility or through any other program for thehomeless, pursuant to standards and criteria established by rule.

(b)  The provider agency or the authorityoperating and managing its own homeless facility shall determine the degree ofneed for each homeless family or individual and in its determination shallconsider the resources available and the number of potential eligibleapplicants in the area served by the homeless facility or other program for thehomeless authorized by this part.

(c)  The authority may establish by rulestandards and criteria for eligibility, need, and priority for each program;provided that the authority may establish by rule exceptions to theseeligibility requirements based on special circumstances. [L 2006, c 180, pt of§2]
