[§356D-146]  Early withdrawal from program;recovery of grant.  (a)  Any property owner who withdraws without justcause from the Hale Kokua program prior to the end of the five-year periodshall return the state grant for construction improvements within ninety daysof the date of withdrawal.  The authority shall effect the recovery of thegrant, including but not limited to the filing of liens against the realproperty of withdrawing property owners.  The authority shall be awardedreasonable attorneys' fees and costs as determined by the court in any actionbrought to enforce this subpart.

(b)  The county government whose jurisdictionincludes the site shall determine the disposition of the additional unitconstructed with the grant in accordance with the due process of law. [L 2006,c 180, pt of §2]
