[§371-16] Employers and entities offeringlong-term care insurance policies. (a) No later than July 1, 2000, everyemployer, labor organization, retiree organization, or other entity specifiedunder the definition of "group long-term care insurance" undersection 431:10H-104, may apply the guidelines set out in Title 29, Code ofFederal Regulations, section 2510.3-1(j), as amended, if the employer choosesto offer group or group-type long-term care insurance as a benefit to employeesin compliance with the federal Employee Retirement Income Security Act of 1974.
(b) Beginning July 1, 2000, every insurer, ifit chooses, shall be allowed by every employer, labor organization, retireeorganization, or other entity specified under the definition of "group long-termcare insurance", if they choose, to publicize one or more long-term careinsurance policies that are made available under section 431:10H-401.
(c) This section shall not be construed toaffect the marketing by insurers of individual long-term care insurancepolicies to an employer, labor organization, retiree organization, or otherentity specified under the definition of "group long-term careinsurance" under section 431:10H-104.
