[§378-66]  Collective bargaining andconfidentiality rights, takes precedence.  (a)  This part shall not beconstrued to diminish or impair the rights of a person under any collectivebargaining agreement, nor to permit disclosures which would diminish or impairthe rights of any person to the continued protection of confidentiality ofcommunications where statute or common law provides such protection.

(b)  Where a collective bargaining agreementprovides an employee rights and remedies superior to the rights and remediesprovided herein, contractual rights shall supersede and take precedence overthe rights, remedies, and procedures provided in this part.  Where a collectivebargaining agreement provides inferior rights and remedies to those provided inthis part, the provisions of this part shall supersede and take precedence overthe rights, remedies, and procedures provided in collective bargainingagreements.
