§386-23.6  Weekly benefit adjustments forrecipients of services of attendants.  Any permanently and totally disabledemployee awarded and receiving compensation under section 386-23 or 386-23.5,but:

(1)  Who is no longer receiving weekly benefits shall,without application, be entitled to a resumption of weekly benefits from thespecial compensation fund in an amount equal to a percentage of the currentmaximum weekly benefit determined by multiplying the current maximum weeklybenefit rate by a fraction, the numerator of which is the weekly benefit amountthe employee had been receiving and the denominator of which is the maximumweekly benefit rate applicable at the time the weekly benefit award was made.

(2)  Who is receiving one-half of weekly benefits fromthe special compensation fund shall be entitled to weekly benefits in an amountequal to a percentage of the current maximum weekly benefit rate determined bymultiplying the current maximum weekly benefit rate by a fraction, thenumerator of which is twice the amount the employee had been receiving and thedenominator of which is the maximum weekly benefit rate applicable at the timethe weekly benefit award was made.
