§412:5-101  Necessity for bank charter. Except as expressly permitted by federal law or this chapter, no person shallengage in any activity for which a charter to operate as a bank is required bythis chapter, including without limitation the solicitation, acceptance, andholding of deposits in the State, the use of the term "bank", or theexercise of such other powers or privileges restricted to banks underapplicable law unless it is a corporation incorporated in this State and hassuch a charter.
