§431:10C-102  Purpose.  (a)  The purposeof this article is to:

(1)  Create a system of reparations for accidentalharm and loss arising from motor vehicle accidents;

(2)  Compensate these damages without regard to fault;and

(3)  Limit tort liability for these accidents.

(b)  To effectuate this system of motor vehicleinsurance and to encourage participation by all drivers in the motor vehicleinsurance system:

(1)  Those uninsured drivers who try to obtain theprivilege of driving a motor vehicle without the concomitant responsibility ofan ability to compensate adequately those who are injured as a result of amotor vehicle accident are to be dealt with more severely in the criminal orcivil areas than those who obtain the legally required motor vehicle insurancecoverage;

(2)  Those persons truly economically unable to affordinsurance are provided for under the public assistance provisions of thisarticle. [L 1987, c 347, pt of §2; am L 1997, c 251, §12]
