§431:11-108 Confidential treatment. Allinformation, documents, and copies thereof obtained by or disclosed to thecommissioner or any other person in the course of an examination orinvestigation made pursuant to section 431:11-107 and all information reportedpursuant to section 431:11-105 and section 431:11-106, shall be givenconfidential treatment, shall not be subject to subpoena, and shall not be madepublic by the commissioner, the National Association of InsuranceCommissioners, or any other person, except to insurance departments of otherstates, without the prior written consent of the insurer to which it pertainsunless the commissioner, after giving the insurer and its affiliates who wouldbe affected thereby notice and opportunity to be heard, determines that theinterest of the policyholders, shareholders or the public will be served by thepublication thereof, in which event the commissioner may publish all or anypart thereof in such manner as the commissioner may deem appropriate.
