§431:13-106 - Hearings.
§431:13-106 Hearings. (a) Wheneverthe commissioner shall have reason to believe that any person has been engagedor is engaging in this State in any unfair method of competition or any unfairor deceptive act or practice, whether or not defined in section 431:13-103, andthat a proceeding by the commissioner in respect thereto would be to theinterest of the public, the commissioner shall issue and serve upon the persona statement of the charges in that respect and a notice of a hearing to be heldat a time and place fixed in the notice, which shall not be less than fifteendays after the date of the service.
(b) At the time and place fixed for thehearing, the person shall have an opportunity to be heard and to show cause whyan order should not be made by the commissioner requiring the person to ceaseand desist from the acts, methods or practices which are the subject ofcomplaint.
(c) Procedures at the hearing shall begoverned by chapter 91. [L 1987, c 347, pt of §2]
