§431:2-308  Administrative procedure actapplies.  (a)  The rules, notices, hearings, orders, and appeals providedfor in this code are in all applicable respects subject to chapter 91, unlessit is expressly provided otherwise.

(b)  The commissioner shall hold a hearing ifrequired by this code.  The commissioner may hold other hearings as thecommissioner deems necessary for such purposes as are within the scope of thiscode.

(c)  The hearings shall be held at a placedesignated by the commissioner and, at the commissioner's discretion, may beopen to the public.

(d)  Application for a hearing made to thecommissioner pursuant to this code shall be in writing and shall specify inwhat respects the person so applying was aggrieved and the grounds to be reliedupon as a basis for the relief to be demanded at the hearing.  Where thecommissioner has used the authority contained in section 431:9-235 or section431:9A-112 to suspend, revoke, or refuse to extend a license subject to theright of the licensee to have a hearing and has suspended the license pendingthe hearing, the commissioner shall hold the hearing within thirty days afterthe commissioner's receipt of the application unless postponed by mutualconsent.
