§431:9-229  Records of adjuster orindependent bill reviewer.  (a)  Every adjuster or independent billreviewer shall keep a record of all transactions consummated under thelicensee's license.  This record shall be in organized form according to classof insurance and shall include:

(1)  If an adjuster, a record of each investigation oradjustment undertaken or consummated, and a statement of any fee, commission,or other compensation received or to be received by the adjuster on account ofthe investigation or adjustment;

(2)  If an independent bill reviewer, a record of eachbill reviewed and a statement of any fee, commission, or other compensationreceived or to be received by the independent bill reviewer on account of thebill reviewed; and

(3)  Any additional information as shall be customary,or as may reasonably be required by the commissioner.

(b)  All such records as to any particulartransaction shall be kept in the licensee's office, available and open to theinspection of the commissioner during business hours during the five years, andin the case of workers' compensation claims during the eight years, immediatelyafter the date of the completion of such transaction.

(c)  This section shall not apply to life oraccident and health or sickness insurance if the records required of suchinsurance are customarily maintained in the offices of the insurer. [L 1987, c347, pt of §2; am L 2000, c 288, §10; am L 2001, c 216, §14; am L 2003, c 212,§53]
