Chapter 5. Racial Balance Fund

Application
Sec. 1. This chapter applies only to a school corporation that may
impose a levy under IC 20-46-3.

"Fund"
Sec. 2. As used in this chapter, "fund" refers to a racial balance
fund established under section 4 of this chapter.

"Levy"
Sec. 3. As used in this chapter, "levy" refers to a property tax levy
imposed under IC 20-46-3 for the fund.

Establishment of fund
Sec. 4. A school corporation may establish a racial balance fund.

Uses
Sec. 5. Money in the fund may be used only for education
programs that improve or maintain racial balance in the school
corporation. Money in the fund may not be used for:
(1) transportation; or
(2) capital improvements;
even though those costs may be attributable to the school
corporation's proposed programs for improving or maintaining racial
balance in the school corporation.
