Powers of commission
    
Sec. 1. The commission may:
        (1) make rules necessary to carry out its functions; and
        (2) appoint advisory boards it considers necessary.

Sec. 3. (a) The commission shall:
        (1) adopt:
            (A) rules under IC 4-22-2; or
            (B) a policy;
        establishing a code of ethics for its employees; or
        (2) decide it wishes to be under the jurisdiction and rules adopted by the state ethics commission.
    (b) A code of ethics adopted by rule or policy under this section must be consistent with state law and approved by the governor.

Twenty-first century scholars program; rules
    
Sec. 4. The commission shall adopt rules under IC 4-22-2 to implement IC 21-12-6, including:
        (1) rules regarding the establishment of appeals procedures for individuals who become disqualified from the program under IC 21-12-6-9;
        (2) notwithstanding IC 21-12-6-5, rules that may include students who are in grades other than grade 6, 7, or 8 as eligible students; and
        (3) rules that allow a student described in IC 21-12-6-5(b) to become an eligible student while the student is in high school, if the student agrees to comply with the requirements set forth in IC 21-12-6-5(a)(4)(B) through IC 21-12-6-5(a)(4)(D) for not less than six (6) months after graduating from high school.
