Article 10.--PUBLIC IMPROVEMENTS
13-1040.Same; costs; assessments; bonds (cities between 15,000 and
110,000).
The city at large shall pay one-third of the entire cost of the
improvements above authorized and the property liable to special assessment
for similar improvement in the first instance shall pay two-thirds of the
cost of said recurbing, reguttering, resurfacing or repaving, and the same
shall be assessed against the benefit district and apportioned among the
various lots, tracts, pieces and parcels of land within the benefit
district in the same manner as is provided for the construction of similar
improvements in the first instance: Provided, That in cities having a
population of more than fifteen thousand (15,000) and less than one hundred
ten thousand (110,000) the city at large may pay the entire cost of
resurfacing of any such streets and issue bonds in payment of the cost
thereof in the same manner as provided for paying the cost of paving
assessed to the city at large.
The city at large shall pay the entire cost of the repairing of any such
streets and bonds may be issued for the cost of such repairs in the same
manner as bonds are issued to pay the cost of paving assessed to the city
at large. All ordinances, notices, bonds and special meetings to hear
complaints, assessments, spreading and collecting taxes, and proceedings
shall be the same as for similar improvements in the first instance.
