2-1227.Rules and regulations.
The secretary is authorized to adopt rules and regulations:
(a) For the safe handling and storage of commercial fertilizers and
fertilizer materials in bulk;
(b) for the establishment of minimum general standards covering the
design, construction, location, installation and operation for the storage
and handling of commercial fertilizer and fertilizer in bulk
and the prevention of commercial fertilizer, fertilizer materials or
fertilizer in bulk from being introduced into the ground or surface
waters of the state;
(c) for the establishment of minimum general standards covering the
design, construction, location and installation of a structure constructed
for the purpose of confining any spills or discharged fertilizer or
fertilizer material within a specified area;
(d) for the prompt recovery of fertilizer or fertilizer materials
spilled within a specified area;
(e) for dates by which the owners or operators, or both, of facilities
and equipment subject to the provision of this act and in existence prior
to the effective date of this act shall comply with this act;
(f) for the issuance of a stop sale order or stop use order, pursuant to
K.S.A. 2-1232; and
(g) for the administration of this act.
