Chapter 21.--CRIMES AND PUNISHMENTS

Article 36a.--CRIMES INVOLVING CONTROLLED SUBSTANCES

      21-36a15.   Treatment of a controlled substanceanalog.Within 10 days after the initiation of prosecution withrespect to acontrolled substance analog by indictment, complaint or information, theprosecuting attorneyshall notify the board of pharmacy of information relevant to emergencyscheduling as providedfor in subsection (e) of K.S.A. 65-4102, and amendments thereto. After finaldetermination thatthe controlled substance analog should not be scheduled, no prosecutionrelating to thatsubstance as a controlled substance analog may be commenced or continued.
