Article 37.--CRIMES AGAINST PROPERTY

      21-3764.   Theft detection shielding device.(a) Unlawful manufacturing or selling of a theftdetection shielding device isintentionally manufacturing, selling, offering for sale or distributing in anyway a laminated or coated bag or device particular to and intentionallymarketed forshielding and intended to shield merchandise from detection by electronic ormagnetic theft alarm sensor.

      (b)   Unlawful possession of a theft detection shielding device isintentionally possessing any laminated or coated bag or device particular toand designed for shielding and intended to shield merchandise from detection byan electronic or magnetic theft alarm sensor, with the intent to commit theft.

      (c)   Unlawful possession of a theft detection device remover is intentionallypossessing any tool or device designed to allow the removal of any theftdetection device from any merchandise with the intent to use such tool toremove any theft detection device from any merchandise without the permissionof the merchant or person owning or holding such merchandise.

      (d)   Unlawful removal of a theft detection device is intentionally removingthe device from merchandise prior to purchase.

      (e)   Unlawful possession of a sales receipt or universal product code labelis possessing 15 or more fraudulent retail sales receipts or universal productcode labels, or any combination thereof, or possessing the device whichmanufactures fraudulent retail sales receipts or universal product code labels.A person having possession, custody or control of 15 or more such receipts orlabels or such device shall be presumed to possess such items with the intentto cheat or defraud a retailer.

      (f)   Violation of this section is a severity level9, nonperson felony.

      (g)   This section shall be part of and supplemental to theKansas criminalcode.
