Chapter 21.--CRIMES AND PUNISHMENTS

Article 38.--CRIMES AFFECTING GOVERNMENTAL FUNCTIONS

      21-3805.   Perjury.(a) Perjury is intentionally, knowingly and falsely:

      (1)   Swearing, testifying,affirming, declaring or subscribing to any material fact upon any oath oraffirmation legally administered in any cause, matter or proceeding beforeany court, tribunal, public body, notary public or other officer authorizedto administer oaths;

      (2)   subscribing as true and correct under penalty of perjury anymaterial matter in any declaration, verification, certificate or statementas permitted by K.S.A. 53-601 and amendmentsthereto; or

      (3)   subscribing as true and correct under penalty of perjury any statementas required by K.S.A. 75-5743, and amendments thereto.

      (b) (1)   Perjury is a severity level 7, nonperson felony if thefalse statement is made upon thetrial of a felony charge.

      (2)   Perjury is a severity level 9,nonperson felony if the false statement ismade in a cause, matter or proceeding other than the trial of a felonycharge or is made under penalty of perjury in any declaration,verification, certificate or statement as permitted by K.S.A. 53-601 andamendments thereto.
