Chapter 21.--CRIMES AND PUNISHMENTS

Article 38.--CRIMES AFFECTING GOVERNMENTAL FUNCTIONS

      21-3813.   Failure to appear.(a) Failure to appear is intentionally incurring a forfeiture of anappearance bond and failing to surrender oneself within 30 daysfollowing the date of such forfeiture by one who is charged with amisdemeanor and has been released on bond for appearance before anycourt of this state, other than the municipal court of a city,for trial or other proceeding prior to conviction, orintentionallyincurring a forfeiture of an appearance bond and failing to surrenderoneself within 30 days after suchperson's conviction of a misdemeanorhas become final by one who has been released on an appearance bond byany court of this state.

      (b)   Any person who is released upon the person's ownrecognizance, withoutsurety, or who fails to appear in response to a summons or trafficcitation, shall be deemed a person released on bond for appearancewithin the meaning of subsection (a).

      (c)   The provisions of subsection (a)shall not applyto any person who forfeits a cash bond supplied pursuant to law upon anarrest for a traffic offense.

      (d)   Failure to appear is a class B nonperson misdemeanor.
