Article 38.--CRIMES AFFECTING GOVERNMENTAL FUNCTIONS

      21-3853.   Access to records by the attorney general.(a) The attorney general shall beallowed access to all recordswhich are held by a providerthat are directly related to an alleged violation of this act and which arenecessaryfor the purpose of investigating whether anyperson may have violated this act, or for use or potential use in any legal,administrative or judicial proceeding pursuant to the Kansas medicaid fraudcontrol act.

      (b)   No person holding such records may refuse to provide the attorneygeneral with access to such records on the basis that release wouldviolate any recipient's right of privacy, any recipient's privilege againstdisclosure or use, or any professional or other privilege or right. Thedisclosure of patient information as required by this act shall not subjectany provider to liability for breach of any confidential relationship between apatient and a provider.Notwithstanding K.S.A. 60-427 and amendments thereto, there shall be noprivilege preventing the furnishing of such information or reports as requiredby this act by any person.
