Chapter 21.--CRIMES AND PUNISHMENTS
PART II.--PROHIBITED CONDUCT
Article 42.--CRIMES AGAINST THE PUBLIC SAFETY

      21-4220.   Unlawful endangerment.(a) Unlawful endangerment is: (1) While engaged in or as apart of the production of a controlled substance, protecting or attempting toprotect the production of a controlled substance by creating, setting up,building, erecting or using any device or weapon which causes or is intended tocause damage or injury to another person;

      (2)   while engaged in or as a part of the production of a controlledsubstance, protecting or attempting to protect the production of a controlledsubstance by creating, setting up, building, erecting or using any device orweapon which causes physical injury; or

      (3)   while engaged in or as a part of the production of a controlledsubstance, protecting or attempting to protect the production of a controlledsubstance by creating, setting up, building, erecting or using any device orweapon which cause serious physical injury.

      (b) (1)   Unlawful endangerment as described in subsection (a)(1) is aseverity level 8, nonperson felony.

      (2)   Unlawful endangerment as described in subsection (a)(2) is a severitylevel7, person felony.

      (3)   Unlawful endangerment as described in subsection (a)(3) is a severitylevel 5,person felony.
