Article 46.--SENTENCING

      21-4629.   Same; provisions of act held unconstitutional; modification ofsentence previously determined under this act.In the event a sentence of death orany provisionof this act authorizing such sentence is held to beunconstitutionalby the supreme court of Kansas or the United Statessupreme court, the court having jurisdictionover a person previously sentenced shall cause such person to be broughtbefore the court and shall modify the sentence and resentence the defendant asotherwiseprovided by law.
