Chapter 22.--CRIMINAL PROCEDURE

Article 30.--GRAND JURIES

      22-3009.   Counsel for witness.(1) Any person called to testify before a grand jury must be informedthat he has a right to be advised by counsel and that he may not berequired to make any statement which will incriminate him. Upon a requestby such person for counsel, no further examination of the witness shalltake place until counsel is present. In the event that counsel of thewitness' choice is not available, he shall be required to obtain othercounsel within three (3) days in order that the work of the grand jury mayproceed. If such person is indigent and unable to obtain the services ofcounsel, the court shall appoint counsel to assist him who shall becompensated as counsel appointed for indigent defendants in the districtcourt.

      (2)   Counsel for any witness may be present while the witness istestifying and may interpose objections on behalf of the witness. He shallnot be permitted to examine or cross-examine his client or any otherwitness before the grand jury.
