Article 40.--EXECUTION OF DEATH SENTENCES

      22-4012.   Death order.Whenever any person has been sentenced to death, itshallbethe duty of the clerk of the court before which the conviction wasrendered toissue an order, under the seal of the court, whichshall recite theconviction and sentence and be directed to the secretary of corrections. Theclerk shalldeliver the order to thesheriff of the county in which the conviction was rendered, andsuchsheriff promptly shall transport such convicted person tothe statecorrectional institution designated by thesecretary of corrections and deliver such convict, together with theorder,into the custodyof the warden of the designated institution, who shall receive and safelykeep such convict until the timeofexecution, or until otherwise ordered by the secretary or othercompetent authority. The warden shall notify the secretary of corrections ofthe receipt of the convict and such order.
