Article 40.--EXECUTION OF DEATH SENTENCES

      22-4014.   When death sentence executed aftersuspension.If a sentence of execution is suspendedby an order of a court, the suspension shall continue until the supreme courtorders otherwise.Ifthe sentence isaffirmed, the supreme court shall order the execution of the sentence ofdeath and shall designate a week during which thesentence of execution shall be carried outif the weekpreviously designated by the court has passed. Otherwise, the execution shallbe carried out during the week previously designated by the court.It shall be the duty of theclerk of the supreme court to issue tothe secretary of corrections a warrant under the sealof the court, commanding the secretary or awarden designated pursuant to K.S.A. 22-4001, and amendmentsthereto, to proceed to carry the sentence into execution during theweek designated by the court. The week during which the sentence ofexecution is to be carriedout shall be stated in the warrant. Uponreceipt of thewarrant it shall be the duty of thesecretary of corrections to cause the sentence to be executed as providedby this act during the time designated by the court.
