Chapter 24.--DRAINAGE AND LEVEES
Article 12.--WATERSHED DISTRICTS

      24-1208.   Payment of costs and expenses when petition or resolution isdisapproved byengineer or defeated by voters; tax levy.If the organization of the proposed district is defeated at the specialelection or if the petition or resolution is disapproved by the chiefengineer, the boardof directors or steering committee named in the petition or resolutionshall continue tofunction in a limited capacity for the purposes hereinafter set forth inthis action. Such board or steering committee shall determine theamount ofmoney necessary to pay all of the costs and expenses incurred in thepreparation and filing of the petition or resolution and in the conduct ofthe specialelection and shall certify a statement of such amount to the county clerkof each county in which the proposed district was to be located.Suchcounty clerks shall thereupon ascertain the total assessed valuation of alltaxable tangible property in their respective counties within the proposeddistrict and certify such valuation to the county clerk of thecounty in which theacting chairperson of the board or steering committee of theproposed districtresides.

      Such county clerk shall determine the levy necessary to bespreadagainst the taxable tangible property in the entire proposed district inorder to raise funds sufficient to pay the amount set forth in thestatement and shall certify such levy to the county clerk of theothercounties in which a portion of the proposed district is located.Each of the countyclerks shall then cause such levy to be extended against thetaxabletangible property lying within the boundaries of the proposeddistrict andwithin the clerk's county. The county treasurers of the respectivecountiesinvolved shall remit the funds raised by such levy in their counties to thecounty treasurer of the county in which the acting chairpersonof the board orsteering committee resides. Such treasurer shall holdsuch funds and shall honorwarrants drawn upon such funds by the actingchairperson of the board orsteering committee and countersigned by the acting secretary of the boardor steering committee in payment of the costs and expenses incurred in theproposed organization of the district and shown on the aforementionedstatement of expenses.
