Chapter 24.--DRAINAGE AND LEVEES
Article 8.--LEVEES

      24-802.   Petition for levee; bond; eminent domain proceedings.Whenever a petition is presented to the board of county commissioners ofthe county in which a levee is proposed to be constructed, signed by theowners of a majority of the acreage on which such levee or any portionof it is proposed to be constructed, or which will be benefited by theconstruction of such levee, specifying substantially the place ofbeginning, the general course and termination of such levee, accompaniedby a bond, with surety approved by the clerk of such board, payable tothe state of Kansas, conditioned that the petitioners will pay all costsand expenses accruing in the proceedings in case said levee be notfinally located and allowed, the board of county commissioners shallwith such assistance as may be required of the county surveyor orengineer, determine whether or not to institute proceedings and exercisethe power of eminent domain in accordance with K.S.A. 26-501to 26-516, inclusive.
