Chapter 25.--ELECTIONS
Article 14.--CONTEST OF ELECTIONS

      25-1439.   Time for filing notice of contest; copy of notice to election official.The notice of contest shall be filed within five days afterthe certificate of election is issued except in the case of question submittedelections. In the case of a question submitted on a statewide basis suchnotice shall be filed within five days after the publication of the determinationof the results of such election and in the case of other question submittedelections such notice shall be filed within five days after the certificationby the county board of canvassers of the final abstract of the electionreturns. Within five (5) days after such filing in the case of electionto an office, the clerk of the district court shall cause a copy thereofto be served upon the contestee and upon the secretary of state or the countyelection officer authorized to issue the certificate of election as the case may be.
