Chapter 25.--ELECTIONS
Article 14.--CONTEST OF ELECTIONS

      25-1440.   Contest of question submitted elections; designation of contestee;copy of notice of contest to contestee.When the contest relates to a contest of a question submittedon a statewide basis, the secretary of state shall be designated the contestee,and the clerk of the district court shall cause to be served a copy of thenotice of contest upon said secretary within five days after the noticeof contest is filed with said clerk. When the contest relates to a questionsubmitted in a county, school district, city, township or other subdivisionof government, the governing body thereof shall be designated the contestee,and the clerk of the district court shall cause to be served a copy of thenotice of contest upon the chairperson or clerk of such governing body withinfive (5) days of the filing of the notice with the clerk of the district court.
