Chapter 25.--ELECTIONS
Article 23.--REGISTRATION OF VOTERS

      25-2303.   County election officer designated; deputy county electionofficers, appointment; voter registration agency; definition of terms.(a) The officer responsible for administering the provisions of this actshall be the county election officer. "County election officer" meansthe election commissioner in counties having an election commissioner,and the county clerk in counties which do not have an electioncommissioner. Words and terms defined in chapter 406 of the laws of 1968 shallhave the same meaning in this act as is ascribed thereto in such act, unlessinconsistent with the provisions of this act.

      (b)   "Voter registration agency" means any office in the state, other than anoffice of thedivision of motor vehicles, that providespublic assistance, that provides state-funded programsprimarily engaged in providing services to persons with disabilities,recruitment offices of the armed forces, andthe office of the city clerk in any city of the first or second class. A voterregistration agency shallprovide voter registration services to persons who apply for the agency'sservices or assistance, and upon completion of each recertification, renewal orchange ofaddress form.

      (c)   Deputy county election officers shall maintain records and performduties under the provisions of this act only in the manner prescribed bythe county election officer. County election officers may appoint suchdeputy county election officers as deemed appropriate,including, butnot limited to, the city clerk of any city, personnel in any public highschool, any public library or public institution of higher education, inaddition tothose required to be appointed under the provisions ofsubsection (b).
