Chapter 25.--ELECTIONS
Article 26a.--PRECINCT BOUNDARIES

      25-26a03.   Same; period in which change is prohibited; exceptions.(a) Notwithstanding any other law or provisions to the contrary, noelection precinct shall be created, divided, abolished orconsolidated or the boundaries thereof changed during the period fourmonths prior to each primary election and the succeeding general electionor between January 1 of a year the lastdigit of which is 8 and December 1 ofa year the last digit of which is 0, and from andafter January 1, 1993, between January 1 of a year the last digit of whichis 7 and the time when the legislature has been redistricted in a year thelast digit of which is 2 except in the following cases:

      (a) (1)   If required by the creation of a political subdivision, newprecincts may be created.

      (2)   If there is an alteration of a political subdivision by annexation,new precincts may be created.

      (3)   If a political subdivision annexes an area adjacent to the politicalsubdivision boundary, the annexed area may be included in a precinctimmediately adjacent to it, if the annexed area is in the same legislative district.

      (4)   A municipality or county election officer may establish newelection precincts lying entirely within the boundaries of any existingprecinct and shall designate the new precincts by name or number, or acombination of name and number, which shall include the designated name ornumber of the former precinct.

      (5)   If required to conform and coincide with a federal census blockboundary established by the federal bureau of the census, a county electionofficer may change precinct boundaries.

      (b)   When necessary to comply with the provisions of this act, not lessthan 45 days after the legislature has been redistricted, or by June 10 ina year the last digit of which is 2 (whichever occurs first), precinctboundaries shall be reestablished.
